Insurance Adjuster

Works for the Insurance Company: 
An insurance adjuster is an employee or contractor working on behalf of the insurance company. Their primary duty is to protect the interests of the insurer and assess claims based on the company's policies and guidelines.

Limited Expertise in the Policyholder's Interest: While insurance adjusters are trained to assess damages, their responsibility is to evaluate claims in a manner that aligns with the insurance company’s interests, which may not always result in a fully accurate settlement for the policyholder.

Claims Handling on Behalf of the Insurer: The adjuster evaluates the damages but operates under the insurer’s direction, meaning they might not always provide a comprehensive evaluation. Their goal is to resolve the claim in a way that meets the insurance company's criteria.

Public Adjuster

Works for You, the Policyholder: A public adjuster works exclusively on behalf of the policyholder, ensuring that your best interests are prioritized throughout the claims process. They represent you, not the insurance company.

Ensures an Equitable Settlement: A public adjuster’s role is to ensure you receive a fair and equitable settlement by thoroughly assessing all damages, including hidden or overlooked damages that the insurance adjuster may miss. They use their expertise to evaluate the full scope of the claim, ensuring that the settlement accurately reflects the true value of the damages and losses covered under your policy.

Comprehensive Knowledge of Insurance Policies: Public adjusters have in-depth knowledge of insurance policies and claims procedures. They can interpret policy language, identify coverage limitations, and ensure that no part of your claim is overlooked.

Advocacy and Negotiation: Public adjusters handle the negotiations on your behalf, advocating for your rights and fighting for a fair settlement. They work directly with the insurance company, taking on the responsibility of dealing with adjusters, consultants, and attorneys, so you don’t have to.

Main Responsibilities of a Public Adjuster:

Review Insurance Policies: A public adjuster begins by thoroughly reviewing the insured’s policy to ensure a complete understanding of the coverage limits, exclusions, and conditions. This involves carefully interpreting the fine print of the policy to determine exactly what is covered, including specific endorsements and provisions that may apply. By assessing the policy in detail, the public adjuster ensures that no potential coverage is overlooked and can identify areas where the insurance company may not be fulfilling its obligations. This review is critical for maximizing the recovery for the client.

Damage Assessment: Once the policy is understood, the public adjuster conducts a detailed, on-site inspection of the property to assess the full extent of the damage. This includes a visual inspection of all affected structures and property, noting damages to the roof, walls, foundation, HVAC systems, plumbing, electrical, personal property, and other key components of the property. The public adjuster often works with specialized equipment to identify hidden damage that might not be visible to the untrained eye, ensuring that no part of the property is overlooked in the claims process.

Business Interruption & Expenses: For commercial clients, the public adjuster evaluates business interruption losses, including the financial impact of the loss on the business operations. This could involve reviewing income records, operational costs, and any lost revenue due to the inability to conduct business as usual during the damage repair process. The public adjuster may also assess extra expenses incurred by the business as a result of the claim, such as temporary operating costs, rental equipment, or relocation expenses, to ensure that all potential losses are documented and included in the claim.

Additional Living Expenses: In cases where the property is rendered uninhabitable, the public adjuster will assess the insured's additional living expenses (ALE), which may include temporary housing, meals, storage costs, and other related living expenses. These costs are typically covered by the insurance policy and must be documented and tracked carefully. The public adjuster ensures that all ALE claims are submitted correctly, providing detailed records and receipts to substantiate the client’s claim for reimbursement of these costs.

Damage Estimation: The damage estimation process is a critical step in determining the true value of the covered damages. The public adjuster begins by conducting a thorough scope of work, carefully measuring all areas impacted by the loss, including affected rooms, ceilings, floors, and other structural elements. Modern technology, such as moisture mapping, infrared cameras, and laser measurement tools, is often used to detect hidden moisture or damage within the structure that may not be visible to the naked eye. The public adjuster uses advanced estimating software to provide detailed, itemized reports that offer an accurate and fair value of the damage, ensuring that the estimate aligns with industry standards and the full extent of the loss.

Documentation & Field Reporting: As part of their role, the public adjuster meticulously documents every aspect of the claim, from the initial damage assessment to final settlements. This includes compiling photographic evidence, preparing field reports, creating inventory lists of damaged items, and gathering supporting documentation such as repair estimates, receipts, and other relevant materials. The goal is to build a comprehensive and compelling case that substantiates the insured’s claim. The field report is critical for demonstrating the extent of damages to the insurance company, and it is essential for moving the claim forward in the negotiation process.

Negotiation: Once the damage has been assessed and all supporting documentation has been compiled, the public adjuster steps in to negotiate with the insurance company on behalf of the client. This involves reviewing the insurer’s offer and ensuring that it accurately reflects the true value of the damages and losses. The public adjuster uses their knowledge of insurance policies and industry standards to push back against lowball offers and advocate for the maximum compensation. Negotiation may involve multiple rounds of discussion, but the public adjuster is committed to securing the best possible settlement for the client, ensuring that they receive all benefits they are entitled to under the terms of the policy.

Reopening Claims: If new evidence or discrepancies arise after a claim settlement, the public adjuster has the ability to reopen the claim for further negotiation. This could involve identifying additional damage that was overlooked in the initial assessment, uncovering errors in the insurer’s calculations, or challenging the insurer’s denial of specific claims. The public adjuster will work with the client to gather new evidence, present it to the insurance company, and push for an adjustment to the settlement amount. This process ensures that the client is not shortchanged and that all valid claims are fully addressed.
